TERMS AND CONDITIONS
1. Introduction
Welcome to eGrowth Media (“eGrowth Media”, “we”, “our”, or “us”). This website,
https://egrowthmedia.ae, is operated by eGrowth Media FZE, registered in the United Arab
Emirates at Business Centre, Sharjah Publishing City Free Zone, Sharjah, UAE (Trade
Licence 4428624.01). Contact: Joe@egrowthmedia.co.uk. These Terms govern website use,
enquiries, consultations and general conditions for our services. By using the website you
agree to them. Paid work may be governed by a separately agreed proposal, statement of
work or contract, which takes precedence for that engagement except where mandatory law
requires otherwise. Nothing excludes non-excludable legal rights.
2. Our Services
We offer social media management, personal branding, content creation, video production
and editing, on-site filming and photography, Meta and other paid advertising, lead
generation, marketing funnels, property marketing, investor enquiry campaigns, marketing
strategy, consultancy, coaching and training. Exact deliverables, timing, fees and scope will
appear in the relevant written agreement. We may decline work that is unlawful, misleading,
incompatible with platform requirements or outside our capabilities.
3. Website Use
You must use the website lawfully. You must not use it for fraud, misrepresentation or
unlawful activity, attempt unauthorised access, transmit malware, copy proprietary content
without permission, or interfere with security and availability. We may restrict access to
protect users, systems and our legal interests.
4. Consultations and Free Audits
Complimentary consultations, marketing audits and business assessments are informational
and preliminary. They do not establish an ongoing agency relationship or guarantee
acceptance of an engagement, particular results or future availability.
5. Client Responsibilities
Clients must provide accurate information, supply brand assets and required account
access, respond to approval requests, substantiate advertising claims, ensure permissions
for third-party materials, obtain relevant business and advertising approvals, and comply with
advertising, consumer, privacy and property marketing laws. For property and investment
campaigns, clients must ensure all listings, claims, representations and regulated activities
are lawful. We may reject or suspend suspected unlawful campaigns.
6. Fees and Payments
Fees, payment dates and schedules are specified in proposals, invoices or agreements.
Work may begin after receipt of the agreed initial payment. Recurring services are billed on
the agreed cycle. Fees use the agreed currency and applicable UAE VAT, if chargeable, is
shown as required by tax law. Platform advertising spend is separate unless clearly included.
Clients bear third-party platform charges. We may reasonably suspend overdue work
following written notice, subject to contractual duties and law; collection charges or interest
apply only where lawfully agreed.
7. Delivery and Timelines
We use reasonable care, skill and professional diligence. Delivery depends on timely
access, content, approvals and third-party platform availability. Material changes in scope
may require mutually agreed additional fees or revised timelines. We will communicate
material delays where reasonably practical.
8. Revisions and Approvals
Included revisions are defined in the proposal. Extra revisions, reshoots, scope changes or
post-approval requests may incur agreed additional charges. Clients must review and
approve factual accuracy, including regulated property, financial and investment claims.
Client approval does not remove our independent legal duties.
9. Results and Performance
Outcomes are affected by platform algorithms and policies, competition, budgets, audience
behaviour, client sales processes, websites and changing regulations. Unless expressly
guaranteed in a signed contract, we do not promise specific leads, sales, investors,
enquiries, followers, impressions or returns. Historic results and case studies do not
guarantee future outcomes. Express written performance commitments remain binding.
10. Third-Party Platforms
Our services may use Meta, Facebook, Instagram, Google, hosting, analytics and
scheduling platforms subject to their own terms. We cannot guarantee uninterrupted
availability, advertising approval or continued account access controlled by third parties, but
remain responsible for our own legal and contractual obligations.
11. Intellectual Property
Our website content, branding, creative assets, methodologies and proprietary materials are
protected by applicable intellectual property laws and may not be exploited without
permission. Clients retain ownership of materials they lawfully provide. Once fees are paid,
the client receives rights to final approved deliverables as defined in the agreement.
Third-party licensed materials remain subject to licences. Unused concepts, raw production
files, internal templates, processes and systems stay with us unless assigned in writing. We
will not use identifiable client work, confidential data or personal information for case studies
without necessary permission or other lawful basis.
12. Confidentiality
Each party must protect non-public commercial information, including strategies, customer
lists, account access, campaign data and financial information. Exceptions apply to
information public without breach, independently developed, lawfully sourced or required by
law. Authorised personnel and providers may access it on a need-to-know basis under
appropriate protections.
13. Personal Data
We handle personal data under our Privacy Policy and applicable law. Clients must lawfully
collect and share marketing leads. When we process personal data on behalf of a client, a
separate processing agreement may be required to define instructions, security, data subject
requests and responsibilities.
14. Liability
To the maximum extent lawfully permitted, neither party is responsible for indirect or
consequential losses such as anticipated profits or opportunities. Any business-to-business
liability cap must be stated in the service agreement. Nothing excludes fraud, wilful
misconduct, non-excludable duties or mandatory consumer rights.
15. Suspension and Termination
Engagements may be suspended or terminated under the signed contract for material
breaches, unlawful instructions, persistent non-payment after notice, failure to supply
necessary information, or mutual agreement. Where appropriate we will give reasonable
notice and an opportunity to remedy. Completed work, outstanding fees and refunds are
handled under the contract, Refund Policy and law.
16. Website Information
We aim for accurate and current website information, but articles, marketing content and
case studies are general information, not legal, financial, tax or regulated investment advice.
Users should seek appropriate professional advice. We do not offer guaranteed property or
investment returns.
17. External Links
Third-party sites have independent policies and services outside our control. Review their
terms and privacy notices before using them.
18. Governing Law and Disputes
Applicable UAE law governs these Terms. Subject to mandatory jurisdiction and consumer
protections, disputes go to the competent courts of Sharjah unless another lawful process is
agreed in writing. Statutory complaint and court rights remain unaffected.
19. Changes
We may update website Terms with a new revision date. Material changes to existing paid
engagements are governed by their service agreements and mandatory law.
